WAIVER AND RELEASE OF LIABILITY
PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.
In consideration of being permitted to enter, access, use, observe, or participate in any services, facilities, programs, equipment, classes, training, recovery amenities, sauna use, events, or activities (collectively, the “Activities”) offered by 606 Fitness Training Co. Inc., located at 2507 N Harlem Ave, Chicago, Illinois 60707, Cook County, Illinois (collectively referred to herein as “606 Fitness”), I voluntarily agree to the following:
I acknowledge and understand that participation in fitness, exercise, strength training, cardiovascular activity, personal training, group classes, sauna use, recovery services, and use of gym equipment involves inherent risks, including but not limited to serious bodily injury, illness, permanent disability, paralysis, emotional distress, property damage, and death. I further acknowledge that these risks may result from my own actions, the actions of others, equipment malfunction, facility conditions, negligence, or other known and unknown causes.
I knowingly and voluntarily assume all risks associated with my participation in any Activities at 606 Fitness, whether known or unknown, foreseeable or unforeseeable.
I hereby release, waive, discharge, and covenant not to sue 606 Fitness Training Co. Inc., its owners, officers, directors, shareholders, employees, independent contractors, trainers, agents, volunteers, affiliates, successors, assigns, representatives, landlords, and all related parties (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, damages, losses, costs, or expenses arising out of or related to any injury, illness, death, or property damage sustained while participating in or using the facilities, services, or Activities at 606 Fitness, including claims arising from ordinary negligence to the fullest extent permitted under Illinois law.
I understand that 606 Fitness is a 24-hour access facility and that there may be periods during which no staff or emergency personnel are physically present onsite. I acknowledge that use of the facility during unstaffed hours increases risk and that I voluntarily assume all responsibility for my own safety and wellbeing during such times.
I understand and acknowledge that sauna use, recovery amenities, and physical exercise may not be suitable for all individuals. I agree that I will not use the sauna or participate in Activities if I am under the influence of drugs or alcohol, pregnant without physician approval, suffering from heart conditions, uncontrolled blood pressure, dizziness, illness, dehydration, or any other medical condition that may increase risk. I acknowledge that I am solely responsible for consulting with a physician regarding my ability to participate safely.
I certify that I am physically capable of participating in the Activities and have not been advised otherwise by a qualified medical professional.
I agree to comply with all gym rules, posted signage, safety procedures, staff instructions, and membership policies established by 606 Fitness. I further acknowledge that 606 Fitness reserves the right to revoke or suspend membership or access privileges at its sole discretion for unsafe behavior, policy violations, misuse of equipment, illegal activity, harassment, vandalism, or conduct deemed detrimental to the facility or its members.
I agree that I am financially responsible for any damage caused to equipment, facilities, access systems, lockers, saunas, or property resulting from my actions, misuse, negligence, recklessness, or intentional conduct.
I authorize 606 Fitness and its representatives to obtain emergency medical assistance on my behalf if deemed necessary. I understand that 606 Fitness does not provide medical insurance and that I am solely responsible for any medical costs incurred.
I consent to the use of security cameras and surveillance systems throughout the facility, excluding private areas such as restrooms and changing areas, for purposes of safety, security, operational monitoring, and incident investigation.
I understand that photos, videos, or recordings may occasionally be captured within the facility for promotional or social media purposes. I grant 606 Fitness permission to use my likeness in such materials unless I provide written notice otherwise.
I agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, costs, or attorney’s fees arising out of my participation in Activities or violation of this agreement.
This Agreement shall be governed by and interpreted under the laws of the State of Illinois and Cook County, Illinois. Any legal action arising from this Agreement shall be brought exclusively within Cook County, Illinois.
If any portion of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This Waiver and Release of Liability shall remain valid and enforceable for the entire duration of my membership, access privileges, participation in Activities, and use of the facilities, including all future visits and renewals.
I acknowledge that I have carefully read this Agreement, fully understand its contents, understand that I am waiving certain legal rights, and voluntarily agree to its terms.

I, THE UNDERSIGNED PARTICIPANT, AFFIRM THAT I AM OF THE AGE OF 18 YEARS OR OLDER, AND THAT I AM FREELY SIGNING THIS AGREEMENT. I CERTIFY THAT I HAVE READ THIS AGREEMENT, THAT I FULLY UNDERSTAND ITS CONTENT AND THAT THIS RELEASE CANNOT BE MODIFIED ORALLY. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND THAT I AM SIGNING IT OF MY OWN FREE WILL.
